Actiones ficticiae
- action based on fiction. In Roman l aw it was a group-based actions nearly pretorskim (Actiones honor ariae), the praetor gave modifying any existing action (actio uti lis). The modification consisted in assuming the existence of a f ictional element, which in fact did not take place, and it was necessary for the investigation of the claim [1]. Praetor formułce commended the judge designated to treat the matter as if it actually existed fingowany element (or an existing element does not exist).
